Non-Discrimination/Harassment/Sexual Harassment and Retaliation Policy


Phase Three Brewing is committed to maintaining a safe and secure work environment that is free from all forms of discrimination and conduct that can be considered harassing, coercive, or disruptive, including sexual harassment and retaliation. In keeping with this commitment, discrimination towards or harassment of Phase Three Brewing employees by anyone, including any supervisor, manager, co-worker, vendor, client, customer or visitor of the organization, will not be tolerated. Harassment is defined as an unwelcome conduct, whether verbal, physical, or visual, that is based upon a person’s protected status, such as gender, race, color, marital status, religion, sexual orientation, national origin, age, physical or mental disability, military status, or other
protected group status. Phase Three Brewing will not tolerate harassing conduct that interferes unreasonably with an individual’s work performance, creates an intimidating, hostile or offensive work environment or affects job benefits. Such harassment may include, for sample, kidding, teasing, or practical jokes directed at a person based on his/her race, age, gender, religion, etc. Sexual harassment is conduct based on sex, whether directed towards a person of the opposite or same sex, and may include explicit sexual propositions, sexual innuendo, suggestive comments, sexually oriented kidding, teasing, practical jokes, jokes about obscene printed or visual material and physical contact such as patting, pinching, or brushing against another person’s body. Unwelcomed sexual advances, requests for sexual favors, and other physical, verbal, or visual conduct based on sex constitute sexual harassment.


Phase Three Brewing prohibits retaliation against employees who in good faith make complaints or report concerns—or who provide information or participate in investigations or proceedings—regarding workplace discrimination or harassment and/or workplace violations of, or non-compliance with, matters including, but not limited to, applicable federal, state, and local laws, rules and regulations, Phase Three Brewing policies, or Phase Three Brewing procedures.


Retaliation means adverse action taken against an employee because the employee makes a complaint or reports concerns—or provides information or otherwise participates in an investigation or proceeding regarding complaints or concerns—regarding workplace discrimination or harassment and/or workplace violations of, or non-compliance with, matters including, not limited to, applicable federal, state, and local laws, Phase Three Brewing policies, or Phase Three Brewing procedures. Adverse actions can include, but are not limited to, demotion, denial of promotion, suspension without pay, termination, decrease in salary, other denials of the benefits of employment to employees, and fostering of a hostile work environment.


If employees feel that they have experienced or witnessed discrimination or harassment or retaliation, they should inform Phase Three Brewing either verbally and/or in writing of the unwelcome and offensive behavior. An employee is not required to directly confront any persons who are the source of, or involved in, their problem. Instead, an employee may utilize any of the other avenues of internal complaint, which would be to immediately report the incident to their supervisor or to Evan Morris, Shaun Berns, brittany berns, or through the Phase Three HR email address at people@phasethreebrewing.com. An employee is required to make a
reasonable effort to bring forward any allegations of unlawful harassment or discrimination so that Phase Three Brewing may stop such wrongdoing and prevent future occurrences. Phase Three Brewing forbids the retaliation against anyone for reporting discrimination or harassment, assisting in making a discrimination or harassment complaint, or cooperating in a discrimination or harassment investigation.


Phase Three Brewing prohibits retaliation against employees for requesting a reasonable accommodation for pregnancy. It also prohibits retaliation against employees who refuse to participate in an activity that would result in a violation of an Illinois state or federal law, rule, or regulation.


Phase Three Brewing will investigate all complaints of discrimination, harassment and retaliation thoroughly, discreetly, and promptly. If an investigation confirms that a violation of this policy has occurred, Phase Three Brewing will take appropriate, corrective action up to and including immediate termination of employment.


It is Phase Three Brewing’s policy to comply with the Illinois Human Rights Act and compliance with that Act’s mandate for annual training for each employee will be strictly enforced.
